Capacity to Contract

In general, a minor person (i.e. a child) does not have the capacity to enter into a valid and binding contract.

In California, this means that a contract into which a child has entered is often "voidable" at will by the contracting minor.

For this reason, a system of court ratification has been created in California in order to make contracts for creative or artistic services with minors binding and enforceable.

I will walk through the governing law with a brief essay-a-day on this blog. So stay tuned.
